Terms of Service
Last updated: September 26, 2026
Fammy is operated by Eagle Developers, LLC ("Fammy", "we", "us"). These
Terms govern your use of the Fammy website and service. By creating an
account or using Fammy, you agree to them. If you do not agree, please
do not use the service.
1. What Fammy is
Fammy is a tool for coordinating childcare among people who already know
and trust each other. You create a circle (a "Fammy"), invite people,
post when you need help, and members offer help in return. Fammy is a
coordination tool only: we do not provide childcare, we do not employ,
supply, screen, vet, background-check or supervise anyone in your
circle, and we are not a party to any arrangement you make through it.
Deciding who is fit to care for your children is entirely yours.
2. Your account
- You must be at least 18 years old to create an account.
- Provide accurate information and keep your login credentials secure.
You are responsible for activity under your account.
- You are responsible for the content you post — need details,
children's names and notes, messages and anything else — and you
must have the right to share it with the people in your circle.
- You may close your account at any time from your profile.
3. Circles, owners and admins
Each circle has an owner, who creates it, and may have admins. Owners
and admins can invite and remove members, post and edit needs, and
manage the circle's settings. Information you post in a circle is
visible to the active members of that circle, so only invite people you
are comfortable sharing it with — see section 4.
4. What you share, and who you share it with
Fammy carries the information you put into it to the people you have
invited. Deciding what goes in, and who is in the circle to receive it,
is yours — so:
- Post only what the circle needs to know. Need notes,
locations and children's details are shown to every active member of
that circle. If a detail is not something you would tell each of
them directly — a medical condition, an address you would rather not
publish, a family matter — leave it out or say less.
- Do not share other people's private information without their
say-so. That includes a co-parent, another family's child, or anyone
whose details would end up in a note you type.
- Sharing cannot be undone. Deleting a need or removing a
member stops future access; it cannot retrieve what members have
already seen, or what has already reached them by email, SMS, push
notification or their calendar feed. Treat a post as read the moment
you make it.
- Invitation links are the credential. Anyone holding the link
in an invitation email can see the name of the circle it is for.
Send invitations to addresses you know, and do not forward them.
- Keeping membership current is the owner's and admins' job, not
ours. When somebody should no longer have access to a circle —
a relationship ends, a sitter stops sitting, an address changes
hands — remove them from the Members page. We do not review or prune
your circle's membership, and we cannot tell that someone's access
has outlived its reason.
5. Premium, trial and renewal
- Free and Premium. Joining a circle as a Helper is always
free. A circle on the free plan can post needs up to 30 days ahead,
have up to five members besides its owner, and notify by email; it
cannot post recurring needs or send text-message alerts. Premium
lifts those limits and is offered monthly, yearly, or as a one-time
lifetime purchase. If Premium ends, nothing already in the circle is
removed, but the free-plan limits apply to anything new.
- Subscriptions belong to a circle, not to a person. A
subscription is purchased for one Fammy and covers that circle. If
you own more than one circle, each is subscribed separately, and a
subscription follows the circle if ownership is transferred.
- Free trial. New subscriptions may be eligible for a free trial. Cancel any time before the trial ends
and you will not be charged.
- Auto-renewal. Unless we say otherwise at the point of
purchase, subscriptions renew automatically at the end of each term
at the then-current price, using the payment method on file, until
you cancel.
- Cancel any time. You can cancel whenever you like. Cancelling
turns off auto-renewal; it does not end your access immediately.
Your subscription stays active through the end of the term you have
already paid for, and then simply stops. Free trials must be canceled before the trial ends to avoid being
charged.
- Single Purchases. Some purchases are one-time rather than
recurring. These do not renew and there is nothing to cancel.
- Payments and refunds. Payments are processed by our payment
providers, and purchases made through an app store are also subject
to that store's terms and refund policy. Except where the law
requires otherwise, payments are non-refundable; if something has
gone wrong, email
support@fammy.org and we will
look at it.
- Price changes. We may change prices. Any change applies to
terms beginning after we have told you, so you can cancel first.
6. Acceptable use
Do not use Fammy to:
- break the law, or harass, threaten or endanger anyone;
- post content that is not yours to post, or that infringes someone
else's rights;
- access a circle, account or data you have not been invited to, or
attempt to defeat the service's access controls;
- disrupt, overload, scrape or reverse-engineer the service;
- send unsolicited commercial messages to other members.
We may suspend or remove an account or a circle that breaks these rules.
7. Your content
Your content stays yours. You grant us a limited licence to store,
process and display it for the purpose of operating Fammy for you and
your circle — for example, showing a need to the members you posted it
to, or sending a reminder about a shift you agreed to. We do not sell
your content and we do not use it for advertising.
You remain responsible for that content: for having the right to share
it, for keeping out what does not belong in a shared circle, and for
removing it when it should no longer be there. We store and deliver what
you post; we do not review it.
8. Notifications
Fammy sends email, push and SMS notifications about your circles —
invitations, offers of help, confirmations, reminders and changes.
Message and data rates may apply to SMS. You can adjust notification
settings in your profile; some messages about your account and your
commitments are operational and cannot be turned off while your account
is open.
9. Availability, and changes to the service
Fammy is offered as-is and as-available. We may change, add or remove
features, and we may suspend the service for maintenance. We aim to
keep it running, but we do not promise uninterrupted or error-free
operation. Do not rely on Fammy as the only record of an arrangement
somebody's day depends on.
10. Disclaimers
To the fullest extent permitted by law, Fammy is provided without
warranties of any kind, express or implied, including merchantability,
fitness for a particular purpose and non-infringement. We make no
warranty about the conduct, suitability or reliability of any member of
your circle.
11. Limitation of liability
To the fullest extent permitted by law, Eagle Developers, LLC is not
liable for indirect, incidental, special, consequential or punitive
damages, or for any loss arising out of childcare arrangements made
through the service. Our total liability for any claim relating to
Fammy is limited to the amount you paid us in the twelve months before
the claim arose, or one hundred US dollars, whichever is greater.
12. Indemnity
You agree to indemnify and hold harmless Eagle Developers, LLC from
claims arising out of your use of Fammy, your content, or arrangements
you make with other members.
13. Termination
You may close your account at any time; doing so removes you from your
circles and deletes the records that name you. We may suspend or
terminate an account that breaks these Terms. Sections that by their
nature should survive termination — content licence, disclaimers,
liability, indemnity and governing law — do.
14. Changes to these Terms
We may update these Terms. When we do, we will change the date at the
top of this page, and we will tell you about material changes before
they take effect. Continuing to use Fammy after a change means you
accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of Georgia, United
States, without regard to its conflict-of-laws rules. The courts located
in Georgia have exclusive jurisdiction over any dispute, except where
applicable law gives you the right to bring it elsewhere.
